Vendor Disclosure Statements

The legislative requirements of the Body Corporate and Community Management Act 1997, place a legal obligation on the owner to disclose a range of issues to a prospective purchaser, including matters of material interest which may affect a purchaser or their mortgagee. This is known as "implied warranties". If a seller does not properly disclose all relevant issues concerning the body corporate, the purchaser may cancel the contract, and in some cases, sue for damages. Sellers are warned to be very careful when preparing, or having prepared, a disclosure statement. The legislation regarding implied warranties is very complex.
